Terms of Service

These terms are an agreement between you and hooded covering your use of hooded.club and its related interfaces (the "Service"). By using the Service you accept them. If you do not accept them, do not use the Service.

1. What the Service is

hooded is an interface for creating and trading tokens on a public blockchain. It helps you send transactions; it does not execute them for you and does not hold your funds on your behalf.

We are not a broker, an exchange, a bank, a custodian or an investment adviser. Nothing in the Service is financial, investment, legal or tax advice. Nothing in it is an offer or a recommendation to buy or sell anything. Decisions you make are yours.

2. Who may use it

You must be at least 18 and legally able to enter into this agreement. You must not be located in, or acting on behalf of anyone in, a country subject to comprehensive sanctions, and you must not appear on any applicable sanctions list. You are responsible for knowing whether the Service is lawful where you are.

3. Your account and your wallet

Signing in creates an account through our authentication provider, and a wallet associated with it. You control that wallet. We do not hold its keys and cannot move its funds, recover it for you, or reverse anything sent from it.

Keep your sign-in method safe. If you lose access to it, you may lose access to the wallet and everything in it, and we will not be able to restore either.

4. Linking a wallet you already own

You may link an external wallet by proving control of it. Proving control requires you to send a transaction from that wallet. That transaction is yours: you pay its network cost, it is final, and we do not refund it. Link only wallets you control.

5. Creating a token

If you create a token you supply its name, symbol, image and description, and you are responsible for them: for having the right to use them, and for them not being unlawful, deceptive or infringing.

We may cover the network cost of a launch. We may also refuse a launch, or stop displaying a token in our interface, at our discretion — for example where it appears unlawful, impersonates someone, or is designed to mislead. A token that exists on the blockchain continues to exist whether or not we display it.

6. Fees and the fee share

Trading a token through the Service incurs a fee that is set on-chain by the pool, not by this interface. A share of the fees generated is attributed back to the trader whose activity produced them, and a share to the token's creator. How much lands, and when, depends on the on-chain rules of the pool and on the network — not on us.

Attribution is computed from on-chain events. We aim for it to be exact, and we check it, but we do not guarantee that any particular amount will arise, land, or be available to you.

Time limit. An attributed amount expires 180 days after the trade that produced it. Anything not taken within that period ceases to be available to you and is applied to the platform's marketing budget. This limit is part of how the fee share works, not a penalty.

Availability. Taking an attributed amount is not enabled at all times, and is not enabled today. We will say in the Service when it is. Until then, figures shown are a record of attribution, not a promise of payment, and they may be recalculated if we find an error.

7. Risks you accept

  • Tokens of this kind are highly volatile and frequently lose all of their value.
  • Blockchain transactions are irreversible; a mistake cannot be undone by us or by anyone.
  • Smart contracts may contain defects.
  • Networks and third-party services may be delayed, congested or unavailable.
  • Prices and figures shown may be stale or wrong.

You may lose everything you put in, and you should not put in more than you can afford to lose entirely.

8. What you must not do

  • Break the law, or use the Service to help anyone break it.
  • Manipulate a market, including by coordinated trading intended to mislead others.
  • Impersonate any person or organisation.
  • Upload unlawful or infringing content.
  • Interfere with the Service, probe it, or work around its limits and access controls.
  • Use automated means to place load on it beyond ordinary use.

9. Availability

We may change, suspend or discontinue any part of the Service at any time. We do not promise it will be available, uninterrupted or free of error.

10. Content and marks

The Service, its design and its marks belong to us. By submitting a token's name, symbol, image or description, you grant us a non-exclusive, worldwide, royalty-free licence to display and distribute them in connection with the Service. You keep whatever rights you had in them.

11. Disclaimer and limits

To the fullest extent the law allows, the Service is provided "as is" and "as available", without warranty of any kind.

To the fullest extent the law allows, we are not liable for lost profits, lost tokens, lost opportunity, or indirect, incidental, special or consequential loss; and our total liability arising out of the Service is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred United States dollars.

Nothing here excludes liability that cannot lawfully be excluded.

12. Indemnity

You will indemnify us against claims, losses and costs arising from your use of the Service, your breach of these terms, or your infringement of anyone's rights.

13. Ending it

You may stop using the Service at any time. We may suspend or end your access if you breach these terms or where we reasonably need to.

14. Changes

We may update these terms. When we do, we will change the date at the top. Continuing to use the Service after a change means you accept the updated terms.
